4. User Accounts and Registration

5. Subscriptions, Payments, and Billing
5.1 Subscription Plans
We offer various subscription plans with different features and durations. All subscription details, including pricing and features, are clearly displayed at the time of purchase and may be updated periodically.
5.2 Billing and Payment
- Billing Cycles: Subscriptions are billed in advance for the selected period (monthly, annually, etc.)
- Payment Methods: We accept major credit cards and other payment methods as displayed
- Payment Processing: Payments are processed by secure third-party payment processors
- Failed Payments: Service may be suspended for failed payments until resolved
5.3 Automatic Renewal
Subscriptions automatically renew at the end of each billing cycle unless cancelled before the renewal date. You will be charged the then-current subscription fee using your selected payment method.
5.4 Cancellation Policy
You may cancel your subscription at any time through your account settings. Cancellation becomes effective at the end of your current billing period, and you will retain access until that time.

We continuously work to improve AI accuracy but cannot eliminate all errors. Report any concerning inaccuracies to help us enhance the Service.
11. Service Availability and Modifications
11.1 Service Availability
While we strive for high availability, we cannot guarantee uninterrupted access to the Service. Downtime may occur due to maintenance, updates, technical issues, or circumstances beyond our control.

- Cost of substitute services
- Loss of goodwill or reputation
- Exam failure or poor performance
- Any other intangible losses
14.2 Cap on Direct Damages
Our total liability for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $100, whichever is greater.
14.3 Essential Terms
These limitations are essential elements of the agreement between us. The Service would not be provided without these limitations.
14.4 Jurisdictional Variations

16.2 Mandatory Arbitration
PLEASE READ THIS SECTION CAREFULLY - it affects your legal rights and eliminates your right to trial by jury for most disputes.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.
Arbitration Rules:
- The arbitration will be conducted by a single arbitrator
- The arbitration will take place in Delaware or via video conference
- The arbitrator's decision will be final and binding
- Each party bears their own costs and fees
16.3 Class Action Waiver
You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
16.4 Opt-Out Right
You may opt out of this arbitration agreement by sending written notice to support@onlyhighyield.com within 30 days of account creation, stating your desire to opt out of arbitration.
16.5 Small Claims Court
Either party may pursue claims in small claims court if the claim qualifies and the court has jurisdiction.
16.6 Injunctive Relief
Nothing prevents either party from seeking injunctive or other equitable relief in court for intellectual property infringement or other irreparable harm.
17. Force Majeure
We shall not be liable for any failure or delay in performance under these Terms due to circumstances beyond our reasonable control, including but not limited to:
- Acts of God, natural disasters, or severe weather
- War, terrorism, civil unrest, or government actions
- Internet outages or infrastructure failures
- Pandemics or public health emergencies
- Strikes, labor disputes, or supplier failures
- Cyber attacks or security breaches
During such events, our obligations will be suspended to the extent affected, and we will make reasonable efforts to minimize disruption.
18. Severability and Entire Agreement
